These Terms of Use (the "Terms") set out the legal framework for the availability of the homnes.co website and its services, and define the conditions under which the "User" may access and use the services.
These Terms are available on the site under the "Terms" section.
ARTICLE 1: LEGAL NOTICES
The editing and publication of homnes.co is managed by Pezaku Kety, email: hello@homnes.co. The site is hosted by Shopify.
ARTICLE 2: SITE ACCESS
The homnes.co site gives the User free access to the following service: online sale of cosmetic products. The site is freely accessible from anywhere to any User with an internet connection. All costs incurred by the User to access the service (hardware, software, internet connection, etc.) are at the User's expense.
ARTICLE 3: DATA COLLECTION
The site collects and processes personal information in compliance with privacy law, in accordance with French Law no. 78-17 of 6 January 1978 on data protection and freedoms. ARTICLE 4: INTELLECTUAL PROPERTY
Trademarks, logos, signs and all content on the site (text, images, sound…) are protected by intellectual property law, and in particular by copyright. Homnès is a registered trademark of Homnès SAS. Any partial or total representation, reproduction, or exploitation of this trademark, of any kind, is strictly forbidden. The User must obtain prior authorisation from the site for any reproduction, publication, or copy of the various content. The User agrees to use the content of the site strictly in a private setting; any commercial or advertising use is strictly forbidden. Any total or partial representation of this site, by any means, without the express authorisation of the site operator, would constitute an infringement punishable under Article L.335-2 et seq. of the French Intellectual Property Code. As stated in Article L.122-5 of the Intellectual Property Code, any User who reproduces, copies or publishes protected content must cite the author and the source.
ARTICLE 5: LIABILITY
The sources of information published on homnes.co are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions. Information provided is for general guidance only and has no contractual value. Despite regular updates, homnes.co cannot be held responsible for changes to administrative or legal provisions that occur after publication. Similarly, the site cannot be held responsible for the use or interpretation of the information contained on this site. homnes.co cannot be held responsible for any viruses that may infect the User's computer or any other IT equipment following use, access, or download from this site. The site's liability cannot be engaged in cases of force majeure or unforeseeable and insurmountable third-party acts.
ARTICLE 6: HYPERLINKS
Hyperlinks may be present on the site. The User is informed that by clicking these links, they will leave homnes.co. We have no control over the web pages to which these links lead, and shall under no circumstances be responsible for their content.
ARTICLE 7: COOKIES
The User is informed that during their visits to the site, a cookie may install automatically on their browser. Cookies are small files temporarily stored on the User's hard drive by their browser, and are necessary for the use of homnes.co. Cookies do not contain personal information and cannot be used to identify anyone. A cookie contains a unique identifier, randomly generated and therefore anonymous. Some cookies expire at the end of the User's visit; others remain. The information contained in cookies is used to improve homnes.co. By browsing the site, the User accepts them. The User may disable these cookies through their browser settings.
ARTICLE 8: APPLICABLE LAW AND JURISDICTION
French law applies to this contract. In the absence of an amicable resolution to a dispute between the parties, French courts shall have sole jurisdiction. For any question regarding the application of these Terms, the editor can be contacted at the details listed in ARTICLE 1.
