Homnès SAS, mindful of individuals' rights, in particular with regard to the processing of personal data, and in a spirit of transparency, has established a data protection charter (hereinafter the "Charter")  pursuant to French Law no. 78-17 of 6 January 1978, as amended, on data processing, data files and individual liberties (loi Informatique et Libertés) and to European Regulation no. 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

 

This Charter is therefore important to you, who wish to have a positive and confident experience of the data processing carried out by Homnès SAS. It is also important to us, as we wish to answer your questions in a precise and appropriate manner and to take your expectations into account while respecting your choices and your rights.

The purpose of this Charter is thus to inform the individuals whose Personal Data is processed of the conditions of the personal data processing carried out by Homnès SAS, a simplified joint-stock company (société par actions simplifiée) with share capital of 500 euros, whose registered office is located at 147 rue d'Aboukir, 75002 Paris, France, registered with the Trade Register (Registre des commerces) under SIRET number 91523731700010, telephone number: +33 6 68 37 11 48, email address: hello@homnes.co, in its capacity as Data Controller (Responsable de Traitement).

Article 1 – Personal Data processed 

Personal data means any information concerning an identified or identifiable natural person (hereinafter the "Data Subjects"); a person is deemed identifiable if they can be identified, directly or indirectly, in particular by reference to a name, an identification number or to one or more specific factors relating to their physical, physiological, genetic, mental, economic, cultural or social identity.

Homnès SAS may process the following personal data (hereinafter the "Personal Data"):

• Identity of individuals: title, last name, and first name;

• Means of contacting individuals: postal address, email address; telephone number;

• Products and services purchased and monitoring of the commercial relationship:  products purchased, the service performed, the delivery address, the history of purchases and services, correspondence with the customer, comments and feedback submitted by the customer ) ;

• Payments: payment validation token. [MOU1] No banking data is collected/recorded by Homnès SAS. Only our partner Payrexx processes the customer's banking data in order to enable online payment for the products ordered.

• Marketing preferences: consent to receive newsletters or promotional communications from Homnès SAS;

• Connection to the servers and to the internet (the Internet Protocol (IP) address; the username and password used when creating the customer account, browsing information);

Article 2 – Purposes and legal bases of the processing

Homnès SAS processes your Personal Data for various reasons/purposes, for example to manage the customer relationship (purchase, warranty), or to keep you informed of news or of its latest commercial offers by email, post, SMS or telephone. 

Depending on the purpose, the processing of your Personal Data is based either on the performance of the contract (or on pre-contractual measures), or on consent, or on the overriding interest of Homnès SAS, or else on compliance with a legal obligation (complaint handling).

More specifically, Homnès SAS may process your Personal Data for the following purposes: 

Processing based on the performance of the contract (or on pre-contractual measures):

• Order processing: shipment of the products ordered by the Data Subjects  ; 

• Provision of assistance to Data Subjects when they contact our customer service, whether pre-contractually or in the course of the contract  ;

• Management of online registrations, access and accounts, including the verification, identification and authentication of the Personal Data provided by the Data Subject;

Processing based on the Data Subject's consent:

• Commercial prospecting for the products and services of Homnès SAS by email, post, SMS or telephone, addressed to persons who have not already provided their Personal Data in connection with a sale of a product or a provision of services by Homnès SAS, or who have provided their Personal Data but in connection with goods and services that are not similar to those for which the Data Subject had provided their Personal Data;

• Organization of special offers, promotions, coupons, prize draws, invitations to events, management of the Homnès SAS referral program

• Placement of cookies in order to offer content and advertising suited to the interests of the Data Subjects of the Homnès SAS site, personalization of services by displaying advertising based on the Data Subject's browsing history and preferences;

Processing based on the overriding interest of Homnès SAS:

• Commercial prospecting by SMS-MMS, telephone call, postal mail and email for Homnès SAS products and services, addressed to persons who have provided their Personal Data in connection with a sale or a provision of services for similar products or services; 

• Management of the operation, optimization and updating of the Homnès SAS website, accessible at: https://homnes.co (hereinafter "the Website ");

• Protection of the site, prevention and detection of fraud and malware (malicious software), and management of security incidents;

• Improvement of products and services: management of customer reviews of our products, requests for reviews, customer satisfaction surveys following receipt of an order, statistical analyses and measurements carried out to improve the experience on the Website;

Processing based on the obligation of Homnès SAS to comply with its legal obligations: 

• Complying with our legal obligations (warranties, complaint handling, pre-litigation and litigation);

• Enabling Data Subjects to exercise their rights.

Article 3 – Retention of Personal Data

Your Personal Data is processed for the time necessary to fulfill the purposes for which it was collected and is archived beyond that period in order to meet legal obligations or to establish a right in legal proceedings.

For further details, we invite you to consult the sections below.

• Your Personal Data is kept in an active database and used for different periods depending on the purposes described above. More specifically: 

• The Personal Data necessary for the performance of the contract is processed for three (3) years from the validation of the order on the Website;

• Without prejudice to the possibility of objecting to or withdrawing consent to this processing at any time, Personal Data processed for commercial prospecting purposes may be retained for a period of three (3) years [MOU2] from the Data Subject's last connection to the Website or from the Data Subject's last interaction with the marketing communications sent by Homnès SAS, whichever of the two periods is the longer; 

• Without prejudice to the possibility of objecting or withdrawing consent at any time, Personal Data relating to a non-customer prospect may be retained for a period of three (3) years from its collection by Homnès SAS or from the last contact initiated by the prospect, whichever of the two periods is the longer;

• At the end of these three (3) year periods, Homnès SAS may contact the Data Subject again in order to find out whether they wish to continue receiving commercial solicitations. In the absence of a positive and explicit response, the Personal Data will be deleted or archived in accordance with the provisions in force.

Personal Data is archived beyond the retention periods described above in order to meet a legal obligation or to establish a right in legal proceedings.

Article 4 – Sharing of Personal Data 

Your Personal Data is disclosed to the internal departments of Homnès SAS that need your Personal Data for the purposes mentioned above, and to the processors of Homnès SAS for mainly operational reasons such as the provision of the online payment service, order deliveries, or maintenance of the Website. 

More specifically, Personal Data may be disclosed to the following recipients, all based in the European Union:

• The sales, IT, after-sales, administrative and marketing departments of Homnès SAS: the Personal Data is passed to the internal departments of Homnès SAS that need to process it for the purposes set out above;

• Product delivery provider;

• Processors: the Personal Data may be passed to processors for the performance of technical tasks (for example database management, sending of prospecting communications, loyalty programs, hosting of the Personal Data) entrusted to them by Homnès SAS in the course of its business. The customer and newsletter databases are hosted by the companies Infomaniak and Mailchimp. ;

• Technical and IT providers in charge of managing the Homnès SAS Website: the Homnès SAS Website is managed and hosted by IT providers, and the Personal Data, in particular data relating to site connections, is processed by these providers. 

Article 5 – Security

Homnès SAS undertakes to implement all necessary means to ensure the security and confidentiality of the Personal Data.

Accordingly, in order to protect the Personal Data of the Data Subjects , Homnès SAS takes all useful precautions and follows best practices in this area to ensure that the said Personal Data is not lost, altered, damaged, misappropriated, accessed, disclosed, modified or destroyed inappropriately, in particular through the physical protection of its premises, the implementation of authentication processes with personal and secure access via confidential usernames and passwords, connection logging, and the encryption of certain Personal Data.

Article 6 – The rights of the Data Subjects

You may receive commercial offers from Homnès SAS. [MOU3] If you do not wish to, you can unsubscribe by following the link available at the bottom of the email you receive, under the wording “You can update your preferences or unsubscribe from this mailing list”.

In addition, pursuant to the regulations applicable to Personal Data, the Data Subjects have the following rights:

• the right of access: they may exercise their right of access in order to obtain confirmation as to whether or not their Personal Data is processed by Homnès SAS and, where it is,  to obtain communication of it as well as the information provided for by the applicable Regulation; 

• the right to rectification: if the personal data processed by Homnès SAS is inaccurate or incomplete, they may request that this Personal Data be updated;

• the right to erasure: they may request the erasure of their Personal Data where one of the following grounds applies: (i) the Personal Data is no longer necessary in relation to the purposes for which it was collected; (ii) they withdraw their consent to the processing and there is no other legal basis for the processing; (iii) they object to the processing of their Personal Data and there is no overriding legitimate ground for the processing; (iv) the Personal Data is being processed unlawfully; (v) the data must be erased in order to comply with a legal obligation;

• the right to restriction of processing: the Data Subjects may ask Homnès SAS to restrict the processing of the Personal Data in the following cases:

• where the right to rectification is exercised, restriction of processing may be required for the period enabling Homnès SAS to verify the accuracy of the data;

• where the right to object is exercised, for the period of verification as to whether the overriding interests pursued by Homnès SAS prevail over those of the data subject;

• in the event of unlawful processing of their Personal Data, the data subject may require a restriction of its use rather than an erasure;

• where the Personal Data should be erased pursuant to article 4 of this Charter but is still necessary for the establishment, exercise or defense of legal claims.

• The right to withdraw consent: for processing based on consent, the Data Subjects may at any time withdraw the consent they have given for the processing; 

• the right to object to the processing of the Personal  Data: the Data Subjects may object to their Personal Data being processed under the following conditions:

• for processing carried out for commercial prospecting purposes:  without having to give any particular reason;

• for all other purposes, in connection with processing based on the overriding interest of Homnès SAS: on grounds relating to their particular situation, unless Homnès SAS demonstrates that there are legitimate and compelling grounds which override the interests and rights and freedoms of the Data Subjects, or for the establishment, exercise or defense of legal claims; 

• the right to portability: they may obtain the Personal Data they have provided to Homnès SAS in a structured, commonly used and machine-readable format so that the Data Subjects can transmit it, or ask Homnès SAS to transmit it, where technically possible, to another data controller. This right applies where the processing is based on consent or on the performance of a contract and is carried out by automated means.

In the event of doubt as to the identity of the Data Subject, Homnès SAS reserves the right to make the handling of their request conditional on receiving proof of identity. The response will be sent within one month of receipt of the request. This one-month period may be extended by two months if the complexity of the request and/or the number of requests so require.

Article 7 – Entry into force and amendments

This Charter came into force on 19 April 2022

The version of this Personal Data protection policy Charter currently online is the only enforceable version for the entire duration of use of the Website and until a new version replaces it.

We reserve the right to amend this Charter at any time, in whole or in part.
